Registering a lease deed is an essential step in establishing a legally binding agreement between a lessor (landlord) and a lessee (tenant) for the rental of property. Below are the key steps involved in registering a lease deed:

  1. Drafting the Lease Deed
  2. Stamp Duty Payment
  3. Execution of the Deed
  4. Registration: Lease deeds exceeding a certain duration (e.g., typically more than 11 months in India) or where registration is mandatory under local laws must be registered with the appropriate authority. This is usually the Sub-Registrar of Assurances or a similar authority. To register the lease deed:
  • Both the lessor and lessee, along with witnesses if required, must appear before the Sub-Registrar.
  • The original lease deed, along with photocopies, identification documents of the parties, proof of payment of stamp duty, and any other required documents, must be submitted.
  • The Sub-Registrar will verify the documents and records and then proceed with the registration process.
  • After registration, the Sub-Registrar will endorse the lease deed, assign a registration number, and affix the official seal.
  • A registered copy of the lease deed will be provided to the parties, which serves as legal proof of the terms and conditions of the lease.
  1. Delivery of Possession: After registration, the lessor typically delivers possession of the property to the lessee as per the terms of the lease agreement.
  2. Stamp duty and registration charges were payable from where is 1.5 to 3.00 of the average annual rent
