Registration of Sale Deed 

The purchaser acquires ownership rights and title in property after registration of the Sale Deed. Registration of Sale confirms a valid sale transaction in favour of the Purchaser.The builder executes the Sale deed in the form of Conveyance Deed in favour of the purchaser at the time of initial direct purchase from the builder. For registration of a sale deed, stamp duty and registration charges are paid on the circle rate the registration sale deed is compulsory under the Transfer of Property Act and Rera Act  

Getting a Certified Copy of the Sale Deed

Any person can obtain a certified copy of the sale deed from the sub-registrar's office where it is registered on payment of the required fee. The sub-registrar will issue the certified copy of the sale deed within 2 weeks. 

Loss of Sale deed 

If the property owner loses the sale deed, he/she must file a complaint at the nearest police station and obtain a non-traceable certificate from the police station. The property owner should publish an advertisement in the newspaper about the loss of the sale deed after getting the non-traceable certificate. The owner should file a declaration suit and obtain the decree of declaration from the competent court, which is as good as a Sale deed  

Cancellation of a Sale Deed

Buyer or seller can cancel the sale deed by filing a suit for cancellation in court in case of any fraud. When the sale deed is cancelled,  the ownership will revert to the seller.

List of documents required for Registration of Sale Deed 

  1. Name and address of the purchaser
  2. Name and address of the seller,
  3. Adhar card of the parties 
  4. Stamp Paper, Registration charges receipts 
  5. TDS certificate
  6. NOC from Municipal Corporation  
  7. Property Tax payment receipt- No Dues 
  8. Two witnesses of the parties, along with ID proof.

Mutation Entry of  Sale Deed  Post-Registration  

  • Mutation of Property – Update records in municipal or revenue offices.
  • Transfer of Utility Services – Electricity, water, and other connections.

 Stamp Duty payable on Sale Deed   

Stamp Duty is paid on the transaction Value  @ 5% in Rural areas and @ 7% in urban areas.
